Robert Schiavelli, New York man, faces fine or jail time for ‘Laughing Too Loudly’ In His Long Island Home
A Long Island man was issued court summons for laughing too loudly in his own home, CBS New York wrote in a report as a neighbor issued complaints against 42-year-old New Yorker.
Robert Schiavelli, age 42, has seizures and other neurological problems, claims he laughs as a defense mechanism against the taunts of his neighbor, Daniel O’Hanian.
A judge declined to throw out the complaints at a Tuesday arraignment, and now Schiavelli, who lives with his mother, could face $500 in fines or 30 days in jail.
“(The neighbor) started mocking me – ‘retard’ this; mocking dance around,” he said. “I think it’s the stupidest thing I’ve ever heard of in my life.”.
His lawyer, Andrew Campanelli, called the summonses “absurd,” and Schiavelli said he wasn’t aware it was “a crime to laugh out the window,” the New York Post reports.
Robert Schiavelli was a special education student who has a high school diploma. He said he loves looking out the window.
