Nebraska Supreme Court to Hear Oral Arguments in Same-Sex Divorce Lawsuit
PRESS RELEASE: The case will decide whether Nebraska courts can grant divorce or dissolution in a same-sex “marriage” lawfully entered into in another state, as the Nebraska State Constitution states, “Only marriage between a man and a woman shall be valid or recognized in Nebraska.”
Bonnie Nichols and her same-sex partner, Margie Nichols, residents of Nebraska, were married in Iowa in 2009, several months after that state legalized same-sex marriage.
In 2012 Bonnie Nichols filed for a divorce in Nebraska. In 2013, a judge sustained defendant Margie Nichols’ Motion to Dismiss, because a divorce cannot be granted without recognizing the marriage itself, something Nebraska’s constitution prohibits.
