Rory Ellinger, Missouri Democrat, proposes bill to ban guns, gives owners 90 days to surrender weapons

Missouri Democrats have introduced a measure that if passed into law, would give owners of certain types of “assault” weapons 90 days to either turn them in to authorities

According to House Bill 545, “assault” rifles are defined as any semi-automatic rifle with a detachable magazine that has one or more of the following characteristics:

a. A pistol grip or thumbhole stock;

b. Any feature capable of functioning as a protruding grip that can be held by the nontrigger hand;

c. A folding or telescoping stock; or

d. A shroud attached to the barrel, or that partially or completely encircles the barrel, allowing the bearer to hold the firearm with the nontrigger hand without being burned, but excluding a slide that encloses the barrel.

The law also applies to certain semi-automatic pistols and semi-automatic shotguns with similar characteristics.

Democrats in the state also want to confiscate pistols or rifles with fixed magazines that can hold more than ten rounds of ammunition.

The law also prohibits anyone, including gun makers, from manufacturing, importing, possessing, purchasing, selling, or transferring any “assault weapon” or large capacity magazines.

The law does not apply to law enforcement officers, members of the military and federal agents and employees.

Those already in possession of these weapons or magazines will have 90 days to:

  1. Remove the assault weapon or large capacity magazine from the state of Missouri;
  2. Render the assault weapon permanently inoperable; or
  3. Surrender the assault weapon or large capacity magazine to the appropriate law enforcement agency for destruction, subject to specific agency regulations.

If the proposal becomes law, those who violate it will be charged with a Class C felony, punishable by up to seven years in prison.

“It’s disarmament and a complete dissolve of the Second Amendment,” Dana Loesch wrote on her website.

But, Loesch says, the proposal has very little chance of becoming law since Republicans hold a super-majority in the state legislature.

“The bill has only been introduced and read twice; it’s a go-nowhere bill but designed, I think, to test the waters as we’ve seen numerous bills of similar sort introduced in other states,” she added before posting the contact information of the Democrats proposing the measure.

  1. Missouri Rep wants to ban gun control laws and gun bans - The Global Dispatch says:

    […] Leara’s legislation faces uncertain prospects and would risk a First Amendment challenge even if enacted. But he called the measure necessary in the wake of gun control measures being floated after the massacre of 20 children in Newtown, Conn. late last year. He specifically cited a recently introduced bill to ban assault weapons and high-capacity ammunition magazines. […]

    Rory Ellinger is a radical who was a proud member of Students for a Democratic Society, the ultimate commie sympathizers, when he was a student at the University of Missouri in the 1960s. His daugther is a leader of the Occupy movement in St. Louis and a member of the International Workers of the World, a union which advocates violence to achieve its means. And I thought Obama was a radical Marxist.

  3. Two Amend says:

    THE Same guy supports a bill to remove misdemeanor drug charges from records of those arrested!!! while with this bill, makes law abiding citizens felons for keeping what was legally purchased today. It is for politicians like this that the 2nd Amendment was adopted, who want to disarm the very ones who can assist in the maintenance of the “free state!” Why don’t the state politicians raise up the “well-regulated militia” to fight the armed criminals and protect the innocent, producing the “free state” envisioned by the 2nd amendment. I would happily be trained and regulated to stand outside a school armed with my AR-15 protecting my children! But these criminal loving *%*(&^#’s want to keep the druggies and inner city thugs safe and free because they are the ones who keep them elected. God, they are going to bring us to the streets….
