Few facts live on in the Michael Brown case. Just after the facts emerged that Brown had just robbed and physically assaulted a store owner, the “Hands Up, Don’t Shoot” narrative was born. Of course, Don Lemon at least confessed as much.

Even the Washington Post proclaimed that Brown was an “inappropriate symbol” for the racism and prejudice shown to blacks in Ferguson.

Officer Darren Wilson was attacked by Brown when he arrived on scene, a fact confirmed by witnesses who stated that Brown reached into the SUV through the open driver’s window, punched and grabbed Wilson. This is corroborated by bruising on Wilson’s jaw and scratches on his neck, the presence of Brown’s DNA on Wilson’s collar, shirt, and pants, and Wilson’s DNA on Brown’s palm.

Brown then grabbed the weapon and struggled with Wilson to gain control of it. Wilson fired, striking Brown in the hand. Autopsy results and bullet trajectory, skin from Brown’s palm on the outside of the SUV door as well as Brown’s DNA on the inside of the driver’s door corroborate Wilson’s account that during the struggle.

The assertion of Brown even raising his hands is inconsistent with the physical and forensic evidence; some of the accounts are inconsistent with witness’s statements, despite what they initially reported either to federal or local law enforcement or to the media.

Despite the varying accounts of how he was moving – i.e., “charging,” moving in “slow motion,” or “running” – they all establish that Brown was moving toward Wilson when Wilson shot him.

Lezley McSpadden, the mother Brown, appeared at the Democratic National Convention on Tuesday as part of the group “Mothers of the Movement,” but did not speak.

“To have that lady come speak when her son was a criminal who tried to kill a police officer is a travesty,” Kevin Jackson said on The Kelly File. “It is a slap in the face to law enforcement and there is no other way to talk about that.”
