Robert Rodriguez, father of Justin Kowalczik, not talking or helping police

Justin’s body was found last Wednesday, buried in the backyard of the family’s Farmingdale home. The mother’s boyfriend, Robert Rodriguez, was described as the “person of interest.” (Full story here)

Rodriguez has now turned to his lawyer to speak on his behalf.

Rodriguez’s attorney says his client is hanging onto his right to remain silent in this case, refusing to speak to investigators or aid in any way in the investigation.

A child welfare check started the chain of events leading up to finding the boy, who should have been 3 years old now. According to his mother, Heather Kowalczik, he died in the summer of 2010, when he was 17 months old. His cause of death is not yet known, as autopsy reports are still pending, and no charges have been filed.

Rodriguez and Kowalczik have two children together. Rodriguez was not the toddler’s father.
