Judge sets a September trial for Clayton Whittemore in the Alexandra Kogut murder case
A trial date has been set for Clayton Whittemore, the New Hartford man accused of killing his girlfriend, Alexandra Kogut, in her SUNY Brockport dorm room in September.
Whittemore will have at least two hearings (a Huntley Hearing and a Probable Cause Hearing), both scheduled for May 10, before a trial scheduled for September 30.
He appeared in court Wednesday morning where the hearings and trial were scheduled.
According to court documents, Whittemore told police he killed her during an escalating argument and that he “just snapped” when he brutally killed Kogut. There are reports that the legal team may seek insanity pleas.
His defense team, attorneys John Leonard and Mark Curley, intend to argue that police had no probable cause to arrest Whittemore when they found him the night of the slaying at a DeWitt thruway stop.
Kogut’s family did not attend the brief court hearing on Wednesday.
Whittemore’s mother, Sandra Whittemore, sat in the back of the courtroom and wept silently through the entire proceeding.
Clayton remains incarcerated in the Monroe County jail without bail, but did appear in court wearing an orange jumpsuit.
