Christopher Calloway, Silver City man held in Nicole Leon murder case, will get no bond reduction

A  judge refused Thursday to reduce the bond for a Silver City man accused of shooting his girlfriend in the head last month.

Christopher Calloway, age 23, was arrested and charged with murder in the shooting death of Nichole Leon Ortiz, 21, the mother of his infant son.

According to court documents, Calloway told Silver City Police that he had been drinking and that he and Leon were arguing over beans. He had two pistols out, a .22 caliber and a .357 caliber revolver, and said the two were playing Russian Roulette “to a certain extent.”

He said he had unloaded the .357 “except one bullet” and “put the revolver to his head and pulled the trigger twice.” He said his girlfriend then grabbed the gun, put it to her head and pulled the trigger. He said he tried to get the gun from her and it went off. He then he called 911 and “anyone that could help him.”

Police found Leon dead while responding to a welfare check at the Shady Grove Trailer Park.

Members of both the victim’s and the defendant’s families filled the courtroom.

Defense attorney Stacey Ward told the court that the $250,000 cash-only bond was more than 95 percent of the people in New Mexico could afford to pay. She also cited Calloway’s ties to the community, and that a former employer had agreed to act as a third-party guardian for Calloway, and give him a job, should he be released.

Deputy District Attorney Francesca Estevez opposed the bond reduction as well as changing the bond to anything but cash. She cited Calloway’s criminal history, which includes previous charges of battery on a peace officer, a felony charge, which was reduced in a plea agreement to the misdemeanor charge of attempted battery on a peace officer, as well other misdemeanor charges of resisting and evading, and a charge of negligent use of a deadly weapon, which was also dismissed by the prosecutor in a plea agreement in which he pleaded guilty to possession of alcohol by a minor.
