Border patrol Arrests previously deported Sex Offender, Xan Chivalan
U.S. Border Patrol agents from the Tucson Station arrested a previously convicted sex offender after he illegally entered the United States Wednesday morning near Arivaca.
During processing, agents learned Salvin Nehemias Xan Chivalan, a 26-year-old Mexican Guatemalan national, had felony convictions in Charlotte, North Carolina for taking indecent liberties with a child in 2017, where he was sentenced to 12 to 25 months confinement and 24 months of supervised probation.
Xan Chivalan will remain in federal custody to face charges for re-entering the U.S. as an aggravated felon.
All persons apprehended by the U.S. Border Patrol undergo criminal history checks using biometrics to ensure illegal immigrants with criminal histories are positively identified.
Federal law allows agents to charge individuals by complaint, a method that allows the filing of charges for criminal activity without inferring guilt. An individual is presumed innocent unless and until competent evidence is presented to a jury that establishes guilt beyond a reasonable doubt.
